Terms of Service

These Terms govern your use of raisingdifferenttogether.com and your purchase or use of services offered by Raising Different Together. By using the website or purchasing a service, you agree to these Terms.
1. Eligibility and authority
You must be at least 18 years old and legally able to enter into an agreement. If you provide records or information about a child or another person, you represent that you are authorized to provide them and request the applicable services.
2. Nature of RDT services
RDT provides parent-to-parent educational advocacy support, record review, practical information, document organization, drafting assistance, and ongoing case-support options as described on the website or in a written service description. The exact scope and deliverables depend on the package purchased and the records and circumstances presented.
RDT may decline work that is outside the agreed scope, creates a conflict, cannot reasonably be completed, requires a licensed professional, or is otherwise inappropriate for our services. Any material change in scope may require a separate agreement or fee.
3. Not legal, medical, or educational-professional advice
RDT is not a law firm, and Danielle and Casey do not act as your attorneys. Purchasing or using RDT services does not create an attorney-client relationship, professional privilege, or legal representation. Our services are educational and informational and do not replace advice from an attorney, physician, mental-health professional, evaluator, school professional, or other licensed provider. You remain responsible for decisions, communications, deadlines, and actions concerning your child.
4. Purchases, payment, and authorization
Prices and included services are shown at checkout or in the applicable written offer. You authorize Stripe and RDT to charge the payment method you provide for one-time purchases and, when selected, recurring monthly subscriptions. Taxes, if applicable, may be added. You are responsible for accurate billing and contact information.
5. One-time package refunds
You may request a refund for a one-time package before you upload or otherwise submit documents for review and before RDT begins work. Once documents have been submitted or work has begun, the purchase is nonrefundable because time and capacity have been reserved and review may already be underway. To request an eligible refund, email Hello@raisingdifferenttogether.com promptly.
6. Monthly subscriptions
A monthly subscription automatically renews each billing period until cancelled. You may cancel at any time before the next renewal. Cancellation stops future renewal charges but does not create a refund or prorated credit for the current billing period. Access and service continue through the end of the paid billing period, subject to the package terms. You may cancel using any available account or billing link or by emailing Hello@raisingdifferenttogether.com.
7. Documents, cooperation, and timing
You are responsible for providing complete, accurate, readable, and relevant documents and for responding to reasonable questions. Use the designated secure upload method for sensitive records. If you do not submit needed documents, RDT may be unable to begin or complete the review. Because you have paid, the matter may remain open for a reasonable period, but quoted timelines do not begin until RDT receives the information needed to proceed. Extended inactivity may require rescheduling based on current availability.
Any stated turnaround time is an estimate unless RDT expressly agrees otherwise in writing. Delays may result from incomplete records, additional materials, client availability, technical problems, emergencies, or circumstances beyond RDT’s reasonable control.
8. Client responsibility and deadlines
You are responsible for monitoring school, administrative, contractual, appeal, due-process, statute-of-limitations, and other deadlines. RDT does not undertake to identify or preserve every possible deadline. Do not wait for an RDT response when immediate action or licensed legal advice may be required.
9. No guaranteed result
Educational advocacy outcomes depend on facts, records, schools, agencies, providers, decision-makers, law, timing, and other circumstances outside RDT’s control. RDT does not guarantee eligibility, services, placement, reimbursement, settlement, school action, legal outcome, or any particular result.
10. Communications
You consent to receive service-related communications electronically at the contact information you provide. Email and online communication involve security and delivery risks. Routine response-time descriptions are service goals, not emergency-response guarantees. RDT does not provide emergency or crisis services.
11. Confidentiality and testimonials
RDT will use reasonable care with client information and will share it as described in the Privacy Policy, as authorized by you, or as permitted or required by law. RDT will use a testimonial, story, name, image, or identifying case information for marketing only with written permission. Identifying information will be removed unless you expressly authorize its use.
12. Intellectual property and permitted use
The website and RDT-created articles, templates, guides, branding, graphics, and materials are owned by RDT or used with permission. Subject to payment and these Terms, you may use client-specific deliverables for your own family’s noncommercial educational advocacy. You may not sell, publish, mass distribute, remove ownership notices from, or represent RDT materials as your own without written permission.
Documents and records you submit remain yours or their respective owners’ property. You grant RDT permission to access, copy, organize, annotate, and use them as reasonably necessary to provide the purchased services.
13. Acceptable use
You may not misuse the website or services; interfere with security or operation; upload malicious, unlawful, or unauthorized material; impersonate another person; infringe rights; harass RDT personnel; or use RDT materials or communications for unlawful purposes.
14. Third-party services
The website and services rely on third parties such as Stripe, Calendly, ShareFile, hosting, email, and communications providers. Their services are governed by their own terms and policies. RDT is not responsible for third-party outages, security incidents, content, or acts beyond RDT’s reasonable control.
15. Disclaimer of warranties
To the fullest extent permitted by law, the website, content, and services are provided “as is” and “as available.” RDT disclaims warranties not expressly stated in writing, including implied warranties of merchantability, fitness for a particular purpose, title, noninfringement, and uninterrupted or error-free operation. Some jurisdictions do not allow certain disclaimers, so portions of this section may not apply to you.
16. Limitation of liability
To the fullest extent permitted by law, RDT and its operators will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost opportunities, lost data, or decisions made by schools or other third parties arising from the website or services. To the fullest extent permitted by law, RDT’s total liability for a claim will not exceed the amount you paid RDT for the service giving rise to that claim during the six months before the event giving rise to the claim. This limitation does not apply where liability cannot legally be limited.
17. Suspension or termination
RDT may suspend or end access or services for nonpayment, abusive or unlawful conduct, security risk, material breach, conflict, or inability to provide the service appropriately. When appropriate, RDT will explain any remaining deliverables or refund, taking into account work already performed and applicable law.
18. Governing law and disputes
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles. Before filing a non-urgent dispute, you and RDT agree to make a good-faith effort to resolve it through written communication. Any court proceeding must be brought in a court with proper jurisdiction and venue in New York, unless applicable consumer law requires otherwise.
19. Changes and general terms
We may update these Terms prospectively by posting a revised version with a new effective date. Changes will not retroactively alter an already-purchased package unless required by law or agreed in writing. If any provision is unenforceable, the remaining provisions continue in effect. Failure to enforce a provision is not a waiver. These Terms, the Privacy Policy, the applicable service description, and any written purchase terms form the agreement concerning the website and services; specific written purchase terms control if they directly conflict with these general Terms.
